§ 1-4	01.	 Definitions	. 	
 
 (a) 	 In ge	ne	ral.–	 In this subti	tle the	 fo	llowi	ng wo	rds have	 the	 	
mean	ings in	dicat	ed.   	
 (b) 	 Applica	nt.–	 "Ap	plicant" inc	lud	es an assign	ee,	 leg	al re	pres	en-	
tative, or suc	cessor of a person wh	o s	ubmits an a	pplicat	ion for regis	-	
tration of a 	mark under 	this subtitle.   	
 (c) 	 Mar	k.– 	"Mark	" mea	ns a name, sy	mbol, wo	rd, o	r co	mbination 	
of 2 	or m	ore 	of th	ese th	at 	a pers	on:	   	
 	 	(1) 	places 	on	 go	ods th	at t	he p	erso	n se	lls 	or d	istrib	utes,	 a c	on-	
tain	er o	f th	e go	ods,	 a dis	play assoc	iated w	ith th	e go	ods,	 or a 	labe	l or

§ 1-4	03.	 Rec	ords	. 	
 
 	The S	ecretar	y of S	tate sh	all k	eep a pu	blic	 rec	ord of the marks r	eg-	
ister	ed un	de	r this subtit	le.   	
 
 
§ 1-4	04.	 Re	gistra	tion author	ized.	 	
 
 (a)	  In gener	al.–	 If a per	son us	es a	 m	ark i	n th	e St	ate,	 the	 person 	
may register the mark in 	accord	ance	 with this subtitle	.   	
 (b) 	 Exceptions	.– A	 pe	rson may no	t registe	r a mark that:   	
 	 	(1) 	is dec	eptive, immor	al, or scanda	lou	s;   	
 	 	(2) m	ay dis	parag	e, fa	lse	ly sugg	est a 	conn	ecti	on w	ith,	 or bri	ng 	
int	o cont	em	pt or disr	eput	e:   	
 	 	 	(i) a be	lief;   	
 	 	 	(ii) an individual, living 	or de	ad;   	
 	 	 	(iii) an inst	ituti	on; or   	
 	 	 	(iv) a natio	nal symbo	l;   	
 	 	(3)	 is,	 sim	ulates,	 or	 inc	lud	es a c	oat of 	arms, flag,	 or 	oth	er i	nsig	-	
nia of a g	overnment;   	
 	 	(4)	 is 	or 	incl	udes t	he na	me, por	trai	t, or s	ign	atur	e of 	a l	iving 	
individual, ex	cept w	ith t	he w	ritten consent o	f the 	indiv	idu	al;	 or   	
 	 	(5) is l	ikely, when a	ppl	ied to the 	go	od	s or servic	es of th	e pers	on	, 	
to con	fus	e or dec	eive b	ecause the m	ark	 resem	bles:	   	
 	 	 	(i) ano	ther m	ark reg	istere	d in the St	ate; or   	
 	 	 	(ii) a mark 	or trade n	ame that 	anoth	er p	erson h	as used in 	
the Stat	e an	d has not ab	and	oned.   	
 (c) 	 Limited exception	.– 	(1) U	nless t	he mark	 has bec	ome distinc-	
tiv	e of t	he person's 	go	od	s or ser	vices, a pers	on 	may n	ot r	egister 	a 	
mark that:   
 	 	 	(i) on	ly d	escrib	es or d	eceptively misdescribe	s goods or ser-	
vic	es;   	
 	 	 	(ii) 	prim	ari	ly descr	ibes or dec	eptively misdescr	ibes the	 geo-	
graph	ic or	igin of g	oods or 	serv	ices;	 or   	
 	 	 	(iii) is prim	arily m	erely a	 surnam	e.   	
 	 	(2) 	As e	vidence that 	a ma	rk ha	s bec	ome distinct	ive o	f th	e g	oods 	
or ser	vices o	f a p	erso	n, the S	ecret	ary of St	ate m	ay acc	ept pr	oof t	hat 	
the p	erso	n h	as used th	e mark as a 	mark in th	e State 	or e	lsewh	ere

cont	inuously	 for at	 least	 5 y	ears 	imm	ediately b	efore th	e da	y on	 which 	
the p	erson a	ppl	ies f	or registration.   	
 (d) 	 Re	gistr	ation of tr	ade	 name prohibited	.– 	A pe	rso	n may no	t 	
register a tr	ade nam	e that	 is not a mar	k.

 (c) 	 Effect of 	class	ification	.–	 T	he c	lassific	ation 	of go	ods	 and	 ser-	
vic	es in	 this 	secti	on do	es 	not 	lim	it or e	xten	d th	e r	ights o	f an 	app	lica	nt 	
or registrant. 
 
 
§ 1-4	06.	 App	lica	tions for registration	. 	
 
 (a) 	 In gener	al.–	 An applicant for registration of a mark shall:   	
 	 	(1) subm	it to	 the Secr	etar	y of St	ate:	   	
 	 	 	(i) an app	lic	ation on th	e form that t	he Secr	etar	y of Stat	e 	
prov	ides;	 an	d   	
 	 	 	(ii) 3 sp	ecim	ens or repr	od	ucti	ons of th	e m	ark;	 and   	
 	 	(2) p	ay t	o the Secret	ary of State a 	fee of $50.   	
 (b)	  Sign	atu	re required	.–	 An	 ap	plic	ation sh	all b	e sign	ed, un	der	 	
oath:   	
 	 	(1) 	for an 	ind	ividua	l, by t	he ind	ividu	al;   	
 	 	(2) 	for a partnership, by a partner; or  	 	
 	 	(3) for a corporation or associat	ion, by an of	fic	er o	f the cor	pora-	
tion o	r asso	ciatio	n.   	
 (c) 	 Co	ntent	s of ap	plication	.–	 In addition to	 an	y other i	nforma	tion 	
requ	ired on 	an app	lic	ation form, the form shall requir	e:   	
 	 	(1) th	e nam	e of th	e ap	plicant;	   	
 	 	(2) the bus	iness addr	ess of the applicant;   	
 	 	(3) for 	an 	ap	plic	ant	 that	 is a c	orp	orat	ion, th	e st	ate of inc	orp	ora	-	
tion;   
 	 	(4) th	e good	s or ser	vices with 	whic	h the 	ap	plic	ant us	es th	e 	
mark;   
 	 	(5)	 th	e w	ay the app	lic	ant	 uses t	he m	ark wi	th th	e go	ods 	or s	er-	
vic	es;   	
 	 	(6)	 th	e c	lass 	under	 § 1-40	5 o	f this su	btitl	e to wh	ich 	the 	goods or 	
service	s be	long;   	
 	 	(7)	 th	e dat	e when	 th	e ap	plic	ant 	or th	e a	pplic	ant's	 pre	decessor	 	
in business:   
 	 	 	(i) first us	ed 	the mark an	ywh	ere; and 	  	
 	 	 	(ii) f	irst used	 the m	ark in 	the Stat	e; an	d

(8) a sta	tem	ent that:   	
 	 	 	(i) the a	pplic	ant ow	ns the mark;   	
 	 	 	(ii) an	oth	er pers	on d	oes 	not ha	ve the	 right t	o us	e the m	ark	 	
in the St	ate;	 and   	
 	 	 	(iii) th	e mar	k is not d	eceptively s	imilar to 	a mark	 that an	-	
oth	er pers	on 	has a right t	o use in th	e State.	   	
 (d) 	 Scope of 	sing	le ap	plic	ation	.– 	A single ap	plicat	ion 	for r	egistra-	
tion o	f a mark:   	
 	 	(1) m	ay co	ve	r use of th	e mark with a	ny num	ber o	f go	ods 	or se	r-	
vic	es in a single class; but   	
 	 	(2) m	ay not c	over use o	f the m	ark wit	h go	ods or se	rvic	es in di	f-	
fer	ent classes.   	
 
 
§ 1-4	07.	  Hearin	gs. 	
 
 (a)	  Opp	ortunity for	 hear	ing	.– Be	fore de	ny	ing reg	istration of a	 	
mark,	 the Secret	ary 	of S	tate sha	ll g	ive th	e app	lic	ant an op	por	tunit	y 	
for	 an	 in	for	mal h	earing b	efore th	e Secre	tary	 of Stat	e or th	e S	ecre	-	
tary's d	esig	nee.	   	
 (b) 	 Den	ial 	of registr	ation	 of mark is n	ot con	tested 	case	.– The	 de-	
nial of 	registration of 	a mark 	is not a cont	ested c	ase 	und	er T	itle 1	0, 	
Subtit	le 2 of 	the Stat	e G	overnm	ent 	Articl	e.   	
 
 
§ 1-4	08.	 Repealed	. 	
 
 
§ 1-4	09.	 Issuance and	 contents 	of certificate of registration	. 	
 
 (a) 	 Issuance	.–	 T	he Secr	etar	y o	f Stat	e shal	l re	gis	ter th	e m	ark	 of 	
and issu	e a c	ertific	ate of r	egistrat	ion to	 each appli	cant who	 meets the 	
requ	irem	ent	s of this subt	itl	e.   	
 (b) 	 Co	ntents	.–	 T	he S	ecretar	y o	f St	ate sha	ll inc	lude 	on 	each	 cer-	
tificate of re	gistratio	n:   	
 	 	(1) t	he si	gna	ture o	f th	e S	ecret	ary 	of S	tate,	 un	der t	he se	al 	of th	e 	
Secretary of State; 	  	
 	 	(2) th	e nam	e of th	e re	gistr	ant;

(3) th	e bus	iness of th	e re	gistrant;	   	
 	 	(4) th	e ad	dre	ss of the r	egistrant;	   	
 	 	(5) 	for 	a re	gistrant tha	t is a 	corp	orat	ion, the st	ate of 	incor	pora-	
tion;   
 	 	(6) t	he dat	e that th	e registrant c	laims to have 	first us	ed th	e 	
mark anywh	ere;   	
 	 	(7) t	he dat	e that th	e registrant c	laims to have 	first us	ed th	e 	
mark in the 	State;	   	
 	 	(8) 	a d	escri	ption o	f th	e g	oods or s	ervices wi	th wh	ich the r	egis-	
trant uses th	e mark;   	
 	 	(9)	 th	e c	lass 	under	 § 1-40	5 o	f this su	btitl	e to wh	ich 	the 	goods or 	
service	s be	long;   	
 	 	(10	) a repr	od	ucti	on of th	e mark;	   	
 	 	(11) the	 date	 of regis	tration; and   	
 	 	(12	) the t	erm	 of re	gistr	ation.	 	
 
 
§ 1-410.	 Term and renewal of registration. 	
 
 (a) 	 Term of registr	ation	.–	 Unless registration 	of a mark is 	re-	
new	ed for a 10-year 	term 	as 	provided 	in th	is sect	ion, the re	gis	trati	on 	
exp	ires on th	e ten	th ann	iversar	y o	f its	 eff	ective dat	e.   	
 (b) 	 Re	newal notice	.–	 W	ithin 1 year before registration of a m	ark 	
expires, the 	Se	cretary of	 State shall	 mail to the 	registrant, at the last 	
known a	ddr	ess of the r	egistrant:	   	
 	 	(1) a r	enewa	l applicat	ion form; and   	
 	 	(2) a n	otice t	hat stat	es:   	
 	 	 	(i) the date 	on which th	e current regis	tration expir	es;   	
 	 	 	(ii) 	the da	te 	by w	hich	 th	e Secr	etar	y of 	State must r	eceive 	the 	
rene	wa	l a	pplica	tion 	for t	he r	enewa	l to b	e issu	ed 	and m	ailed be	for	e 	
the registr	ation expir	es; a	nd   	
 	 	 	(iii) the am	ount of th	e re	new	al fee.   	
 (c) 	 Appl	ica	tion for 	rene	wal.–	 Before the registration of	 a	 ma	rk 	
exp	ires, the 	reg	istrant 	periodica	lly ma	y ren	ew it 	for an addition	al 10	-	
ye	ar term	 if, with	in 6 m	onths be	fore t	he e	xpirat	ion of t	he t	erm	 of th	e 	
registration:   
 	 	(1) 	the regis	trant subm	its to th	e S	ecretar	y of St	ate a r	enewa	l 	
app	lica	tion o	n the f	orm	 that the S	ecret	ary o	f Stat	e prov	ides;

(2) th	e re	gis	trant stat	es in the ren	ewal ap	plicat	ion th	at the	 	
mark is stil	l in use in th	e State;   	
 	 	(3) th	e m	ark 	oth	erw	ise is 	ent	itled t	o be	 regist	ered;	 and   	
 	 	(4) t	he r	egistrant pa	ys to 	the S	ecret	ary of Stat	e a r	ene	wa	l fee 	of 	
$50.   
 (d) 	 Issuance	 of renewal	.–	 The Secretary of State shall ren	ew 	the 	
registration of and 	issu	e a ren	ewal certificate to 	each registr	ant wh	o 	
meets th	e re	quir	em	en	ts o	f this sect	ion.   	
 
 
§ 1-4	11.	 Assignm	ent	. 	
 
 (a)	  Aut	horized	.– A mark and 	its r	egistration 	may be ass	igned 	
with:   
 	 	(1) th	e g	ood wil	l of the b	usiness that u	ses the m	ark	; or   	
 	 	(2) that part of 	the go	od wil	l of 	the business 	conn	ect	ed with 	the 	
mark.   
 (b) 	 Manner of 	ass	ignmen	t.– The assignmen	t shall be b	y a writ-	
ten, signed 	instrument.   	
 (c) 	 Rec	ord	ing an 	assign	ment	.– A 	person m	ay r	ecor	d th	e as	sign	-	
me	nt of re	gis	tratio	n of a 	mark by:   	
 	 	(1) subm	itt	ing the instr	ument o	f assignmen	t to th	e Secr	etar	y of	 	
State; an	d   	
 	 	(2) p	aying t	o the Secr	etary of St	ate a 	fee 	of $	10.	   	
 (d) 	 Issu	anc	e of certificate	.– The Secretar	y of State shall rec	ord 	
an assig	nment of th	e r	egistrat	ion 	of 	a m	ark and i	ssue a ne	w certi	fi-	
cate 	of r	egis	tration in th	e nam	e of	 the	 assignee	 to	 each pe	rson who 	
meets th	e re	quir	em	en	ts o	f this sect	ion.   	
 (e	)  Term of assignment.	–	 T	he term	 of	 assi	gnm	ent is th	e r	est of 	
the t	erm	 of r	egistrat	ion of	 the m	ark.	   	
 (f	)  Rights of 	subsequent purchaser	.– An ass	ignm	ent 	of t	he r	egis-	
trati	on of a mark und	er 	this sub	title is v	oid against a subs	equ	ent 	pur-	
chaser 	for v	alua	ble cons	iderat	ion	 w	ithout	 n	otic	e of th	e assig	nment 	
unless th	e as	signm	ent is r	ecor	ded wit	h the Secr	etar	y of St	ate:	   	
 	 	(1) w	ithin 3 	months after	 the 	date	 of the	 assignment; o	r   	
 	 	(2) b	efor	e th	e subsequ	ent 	purchas	e.

§ 1-4	12.	 Canc	ellat	ion 	of re	gistra	tion. 	
 
 (a) 	 In gener	al.–	 The S	ecretar	y o	f Sta	te sha	ll ca	ncel a r	egistra	tion	 	
of a mark if:   
 	 	(1) the	 registrant asks that it be	 canceled;   	
 	 	(2) th	e re	gist	rant fa	ils t	o rene	w it;   	
 	 	(3) a co	urt 	of co	mpete	nt juri	sdi	ction 	orde	rs that 	it be	 cancel	ed 	
on any 	grou	nd; or   	
 	 	(4) a c	ourt o	f comp	ete	nt jurisdict	ion fi	nds that:   	
 	 	 	(i) the mark is aband	oned;   	
 	 	 	(ii) th	e reg	istrant do	es no	t own the m	ark;   	
 	 	 	(iii) the r	egistrati	on was g	rante	d im	pr	operly;	 or

 (b) 	 Re	gis	tra	tio	n in p	aten	t of	fice	.– 	(1) Subje	ct to	 parag	raph (2) o	f 	
this subsect	ion,	 the Secr	etary o	f Stat	e shall canc	el 	the re	gistr	ation 	of 	
a m	ark if 	a c	ourt 	of c	ompetent j	urisd	ictio	n finds t	he m	ark t	o be like	ly 	
to con	fus	e or dec	eive b	ecause it res	embles a m	ark that:	   	
 	 	 	(i) was re	gis	tered by a	nother p	erson 	in the Un	ited States	 	
Patent 	Offic	e befor	e th	e dat	e th	e registrant applied 	for r	egis	tration	 	
unde	r this subtitle	; and   	
 	 	 	(ii) is no	t abando	ned.   	
 	 	(2)	 T	he Secr	etar	y of S	tate m	ay n	ot ca	ncel	 th	e r	egistrati	on 	of a 	
mark if th	e registra	nt prove	s that:   	
 	 	 	(i) the r	egist	rant holds a 	concurr	ent r	egistrat	ion of the mar	k 	
in the	 United State	s Pate	nt Office	; and   	
 	 	 	(ii) th	e regist	ration in th	e Un	ited Stat	es Patent	 Office covers	 	
an area that 	inclu	des th	e State.   	
 
 
§ 1-4	13.	 Fraudulent r	egistration. 	
 
 	A pers	on wh	o, for th	e pe	rson or f	or a	noth	er, app	lies to re	gist	er or 	
reg	isters	 a 	mark und	er this su	btit	le by k	nowingly m	aking	 a false	 or 	
fraudu	lent 	repr	esen	tat	ion, oral	ly or i	n writ	ing,	 or by oth	er fra	udul	ent 	
means 	is 	lia	ble 	for	 an	y d	amag	es sust	ain	ed as 	a r	esult 	of th	e applica	-	
tion or registration.

§ 1-4	14.	 Infrin	gem	ent. 	
 
 (a) 	 In gener	al.– Subjec	t to § 1-402 	of this subt	itle, a pers	on may	 	
not:   
 	 	(1)	 use,	 w	ithout t	he c	ons	ent 	of th	e re	gistra	nt,	 a r	eproduc	tion 	or 	
colorable	 imitatio	n of	 a 	mark register	ed under th	is subtitle in connec-	
tion w	ith 	the sale, offer	ing for sale, or adv	ertisin	g o	f goods or 	servic	es 	
if the	 us	e is lik	ely to con	fuse or dec	eive about the ori	gin of the	 go	ods 	
or se	rvice	s; or   	
 	 	(2) r	epr	od	uc	e or c	olor	abl	y im	itate a 	mark re	gist	ered un	der 	this 	
subtit	le an	d app	ly th	e reproduc	tion or color	able imitat	ion t	o an ad-	
vert	isem	ent, 	lab	el, pack	ag	e, pr	int, r	eceptacl	e, si	gn, 	or wr	app	er that 	is 	
inte	nde	d to	 be	 use	d:   	
 	 	 	(i) with g	ood	s or servic	es;	 or   	
 	 	 	(ii) in conj	un	ctio	n wit	h th	e sal	e or ot	he	r distri	but	ion of 	go	od	s 	
or serv	ices 	in the Stat	e.   	
 (b) 	 Ci	vil liability.–	 (1) A p	erson 	wh	o v	iolates th	is secti	on is 	liabl	e 	
in a	 ci	vil ac	tion	 to a re	gistrant 	for	 an	y r	emedy pr	ov	ided 	in 	thi	s sec-	
tion.   
 	 	(2) A registrant ma	y re	cove	r profits or damage	s fr	om a pe	rson	 	
who 	violates subsect	ion 	(a)	(2) of th	is secti	on 	onl	y if th	e p	erson i	n-	
tend	ed th	at t	he m	ark b	e used to c	onfuse or d	eceive.   	
 (c) 	 In	junc	tion auth	orize	d.– A regis	trant m	ay sue 	to enj	oin th	e 	
disp	lay,	 m	anufactur	e, sal	e, or us	e of 	a repr	od	ucti	on 	or co	lor	able im	i-	
tatio	n of a mark o	f the	 registrant.   	
 (d) 	 Jud	icia	l remedies	.–	 A court 	of co	mpetent j	urisdicti	on m	ay:   	
 	 	(1) 	grant an	 injunction t	o restrain t	he dis	play, manufac	ture, 	
sale,	 or 	us	e of a 	repr	odu	ctio	n or colorabl	e im	itati	on of a 	registered	 	
mark;   
 	 	(2)	 re	quir	e the de	fendan	t to	 pa	y to th	e registrant 	for the wr	ong-	
ful disp	lay, m	anufac	ture	, sale,	 or 	us	e of a 	repro	ducti	on or 	colorable 	
im	ita	tion o	f a m	ark:   	
 	 	 	(i) any pr	ofit that th	e de	fendant d	erived;   	
 	 	 	(ii) any damage	s that the	 registrant suffe	red; o	r   	
 	 	 	(iii) bot	h; and   	
 	 	(3) r	equ	ire t	he d	efend	ant	 to d	eliver to	 an of	fic	er of the co	urt or	 	
to th	e re	gis	trant,	 for des	tructi	on, any r	epr	oduct	ion 	or co	lor	able imita-	
tion of the m	ark that 	is in the p	osses	sion 	or und	er the control of th	e 	
defen	dant.

§ 1-4	15.	 Fraudulent 	use or imit	ation of trad	e names	. 	
 
 (a) 	 Proh	ibited	.–	 Exc	ept as prov	ided 	in subsect	ion	 (b) 	of th	is sec-	
tion, 	a 	person 	may 	not, with int	ent to 	defraud, do busin	ess in 	the 	
State	 und	er 	or 	im	ita	te a 	nam	e, title, or tr	ad	e na	me th	at 	is t	he sam	e 	
as, or s	imila	r to, t	hat 	used 	by	 an	oth	er pers	on 	alr	eady	 doing b	usiness 	
in the St	ate.	   	
 (b) 	 Exce	ption.– This section d	oes n	ot a	pply t	o indiv	iduals 	with 	
simi	lar names.   	
 (c) 	 Penalty	.–	 A pers	on who vi	olates this 	sec	tion i	s gui	lty of a m	is-	
dem	ean	or a	nd, on c	onvict	ion,	 is subj	ect to	 a 	fine	 not exc	eed	ing	 $10	0 	
for each da	y that th	e offense is committed.
