STEP 1 - The Spouse that has decided to file for divorce must complete the following forms: • Arkansas Complaint for Divorce • Summons  STEP 2 - Before you sign the forms, you must go to a Notary (find one at every branch bank) and sign in with the Notary as your witness.  STEP 3 - Make 3 copies of all forms, go to the clerk's office and pay the $165.00 filing fee.  STEP 4 - You will have to send your spouse copies of the stamped and filed Complaint and Summons. In order to do this you must send it to them via Certified Mail with Return Receipt requested. Upon receiving your return receipt, you can fill in the Affidavit of Service Mail Form and file it with the court clerk's office. *If the spouse wants to contest the claim that you are in fact divorcing him or her, your spouse will have to file an Answer form within 20 days.  STEP 5 - You will have to meet with your spouse in order to fill out the Marital Settlement Agreement. This is the form that states exactly what you and your spouse will be separating when it comes to all assets and debts. After

agreeing to the terms, you both must have this signed in front of a public notary.  STEP 6 - As long as it has been at least 30 days since your originally filing date of your Summons and Complaint for Divorce, you can set a date for your court hearing. The witness can be a family member or a close friend (cannot be a previous or present girlfriend or boyfriend).  STEP 8 - If you have a successful hearing the Judge will sign your Divorce Decree and you will need to file them with the clerk and you are officially divorced in the State of Arkansas.  !
