S TEP 1 - The person that has decided to file for divorce must fill out the following forms and submit to the Missouri Circuit Court Clerk's Office: • Petition for Dissolution of Marriage • Statement of Income and Expenses • Filing Information Sheet • $163 filing fee S TEP 2 - Now you must send the following forms to your spouse: • Waiver of Service and Entry of Appearance • Petition for Dissolution of Marriage • Statement of Income and Expenses • Filing Information Sheet *If your spouse does not return the Waiver of Service and Entry of Appearance form then the court will allow you to serve a Summons to the unresponsive spouse to answer the Petition for Dissolution of Marriage that was filed. S TEP 3 - Now you must find a way to get a completed 'Answer and Waiver Form ' from your spouse. Once you receive this form back, you will have to deliver and file it with the clerk. S TEP 4 - Each spouse will need to fill out the following forms in front of a Notary Public and file the forms with the clerk: • Statement of Property • Debt and Proposed Separation Agreement • Parenting Plan A (Custody of The Children ) • Parenting Plan B - (Support of The Children) ***I F Y OU H AV E C HILDREN - You and your spouse must complete divorce parenting education classes (the clerk will direct you to the certified educational courses), and you will receive an official certificate which you will have to return to the clerk's office. S TEP 5 - Now you are eligible to receive a hearing from the court for a certified Judgement . Contact the clerk's office for a court hearing date. Once you have been notified of scheduling, you will have to fill out the Notice of Hearing , file the form with the clerk, and send a copy to your spouse. S TEP 6 - Bring the Judgement of Dissolution of Marriage with you to the court hearing as well as 4 copies. After successful hearing you will be directed to fill out a Certificate of Dissolution of Marriage and file it with the clerk. This will finalize your divorce in Missouri.
