S TEP 1 - The Spouse that has decided to file for divorce must complete the following forms: • Virginia Divorce Petition (Must be Notarized ) • Civil Case Information Sheet • Vital Statistics Sheet • (If you have Minor Children) Bureau for Child Support Enforcement Application and Income Withholding Form S TEP 2 - Now, you must file these forms (make 4 copies) with the the County Court Clerk's Office where you live. Find out the filing fee here . S TEP 3 - To alert your spouse of the divorce, you must serve a copy of the filed Virginia divorce papers as well as the Acceptance of Service . S TEP 4 - You must get a completed copy of the Acceptance of Service from your spouse and file it with the clerk. S TEP 5 - Give your spouse the Answer and (If you have Minor Children) Bureau for Child Support Enforcement Application and Income Withholding form(s) if he or she has not been provided with it yet so that your spouse may file it with the clerk's office. After successful filing, the spouse MUST SERVE the petitioning spouse. *VERY IMPORTANT - Your spouse must complete the Answer form stating the reason for was 'irreconcilable differences' within 20 days of the petition's filing date or the divorce cannot be considered 'no-fault'. S TEP 6 - Both spouses will need to complete the Financial Disclosure Statement form before meeting with each other to negotiate. Pick a time and place to meet, then the both of you should fully negotiate the Separation and Property Settlement Agreement . Once completed, you must file the Separation and Property Settlement Agreement form with the clerk's office as well as both Financial Disclosure Statements . Bring a blank Notice of Hearing form with you as well. While at the clerk's office, schedule a court hearing date (if it has been at least 20 days past the date of the original divorce petition filing). Once you have scheduled the date, fill in th e Notice of Hearing with the clerk so that a copy can be sent to your spouse. S TEP 7 - Bring copies of all filed documents with you to the court on the hearing date. Upon successful completion of all the forms the Judge will authorize a Final Order which will make your divorce complete in the State of Virginia. The Final Order will be sent to both spouses and if you object, you have 5 days to respond, if not, then after 8 days the judgment will be final.
