In the State of West Virginia, the Court requires the Petitioner to serve the divorce summons on the Defendant of a divorce petition along with all the other papers filed with the court clerk. Upon receipt, Defendant must complete the form.
Through the information gleaned from this form, the Court is able to identify the spouse who will pay for spousal support. Moreover, if the couple has minor children, the information in this form will also form the basis of the child support arrangement.
Should there be minor children involved in a divorce case, the spouses must complete this form to determine the custody arrangement to be enforced following the finalization of the divorce.
Upon reaching an agreement regarding the division of assets, debt, and property, divorcing spouses must complete this form and file it with the county court clerk’s office.
This form functions as a cover sheet for any confidential document to be submitted to the Court. Confidential documents can be bank statements or any of the forms that Petitioners and Defendants file with the Court Clerk.
Upon completion of the Parenting Plan Worksheet, this motion must be filed with the Court. If the court approves the motion, the submitted parenting plan will be enforced to the couple after the finalization of the divorce.
In this worksheet, parent/s must indicate their plans for the minor children’s education, extra-curricular, sports, and other activities after the finalization of the divorce.
This form must be completed by the Defendant upon receipt of the copies of the divorce papers that the Petitioner filed with the court clerk’s office.
Following the filing of the divorce papers, Petitioner must serve this summons on the Defendant. Upon receipt, Defendant must complete this form and return it to the Petitioner for filing.
This form functions as the divorcing spouses’ proof of income. Through the fulfillment and filing of this form, the court and both spouses learn about previous and future earnings. The information reflected in this form serves as the basis for the child support arrangement.
